Terms & Conditions

These terms govern the relationship between R.M. Arts ("RM Pulse", "we") and any person or organisation ("you", "Client") using this website or engaging our services. Where a signed service agreement exists, that agreement takes precedence over anything below.

Acceptance of terms

By browsing this website, submitting an enquiry, or accepting a quotation, you agree to these terms. If you do not accept them, please do not use the site or our services.

Our services

RM Pulse provides outdoor advertising services including wall painting advertising, flex and vinyl branding, rural and transit media, campaign management, and GPS-verified photo auditing. The precise scope of any engagement is defined in the accepted quotation and site list, not on this website.

Quotations and pricing

• Quotations are valid for 30 days from issue unless stated otherwise.
• Pricing is quoted as separate line items covering wall rent, material, execution labour and maintenance.
• Rates assume the site list attached to the quotation. Substituting sites of materially different size or location may change pricing.
• Taxes are additional and charged at the applicable statutory rate.
• Indicative rates shown before survey are estimates and are confirmed only after the site survey is complete.

Client responsibilities

• Supplying print-ready artwork, brand colour references and any mandatory statutory disclaimers.
• Confirming that the artwork and claims comply with applicable advertising and sector regulations.
• Approving the surveyed site list within the agreed window, as delays here compress the execution schedule.
• Providing timely approvals on site photography in the client portal.
• Meeting payment milestones set out in the accepted quotation.

Site permissions and compliance

We obtain written permission from wall owners and, where applicable, municipal or gram panchayat clearances for each site. We do not paint or install on any site without documented consent. If a local authority subsequently requires removal of a compliant site, we will relocate the creative to an equivalent site at no additional labour cost, subject to availability.

Responsibility for the legality of the advertising content itself rests with the Client.

Execution, timelines and delays

Timelines are agreed at plan sign-off and stated in the quotation. We commit to those dates and, where we miss them without a documented external cause, affected sites are re-rated as set out in the service agreement.

The following are treated as external causes and do not constitute a breach: prolonged adverse weather, civil disturbance, government restriction, election model code restrictions on outdoor media, delayed Client approvals, late artwork delivery, and any event beyond reasonable control.

Warranty and maintenance

• Hand-painted sites carry a six-month colour warranty from the date of completion.
• Sites that fade materially inside the warranty period are repainted at our cost.
• Printed media carries a three-month warranty against mounting failure and delamination under normal conditions.
• Warranty does not cover third-party defacement, vandalism, demolition of the structure, or damage from events outside reasonable control.
• Quarterly condition sweeps are included on campaigns running longer than six months.

Payment terms

• Standard terms are 40% on plan sign-off, 40% on completion of execution, and 20% within 30 days of the completion report.
• Invoices are raised against approved sites only.
• Amounts unpaid beyond 45 days may attract interest at 1.5% per month.
• Disputed line items must be raised within 15 days of invoice receipt, with undisputed amounts payable on schedule.

Intellectual property

You retain all rights in your brand artwork, trademarks and creative assets. You grant us a limited licence to reproduce that artwork solely for executing the campaign.

We retain rights in our survey data, site inventory, photography workflow, reporting formats and the RM Pulse platform. Campaign photography may be used in our portfolio only with your written consent, which you may withdraw at any time.

Confidentiality

Campaign briefs, budgets, launch timing and unreleased creative are treated as confidential. We do not disclose them to other clients, vendors or partner crews beyond what is operationally necessary, and confidentiality survives the end of the engagement by three years.

Limitation of liability

Our total aggregate liability arising from any engagement is limited to the fees paid by you for the campaign giving rise to the claim. We are not liable for indirect or consequential loss, including loss of profit, anticipated sales, goodwill or business opportunity.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be limited.

Termination

Either party may terminate an engagement in writing. On termination you remain liable for work completed, materials procured, wall rent contracted, and reasonable demobilisation costs incurred up to the termination date. We will provide the completion report for all executed sites.

Use of this website

• Content on this site is provided for information and may change without notice.
• You may not scrape, republish or commercially exploit site content without written permission.
• You may not attempt to gain unauthorised access to any part of the site, the client portal or connected systems.
• Case study figures reflect specific campaigns and are not a guarantee of comparable results.

Governing law and disputes

These terms are governed by the laws of India. The parties will attempt good-faith resolution of any dispute within 30 days. Failing that, disputes are subject to arbitration in Mumbai under the Arbitration and Conciliation Act, 1996, before a single arbitrator, with proceedings in English. Courts at Mumbai have exclusive jurisdiction over matters not subject to arbitration.
